Subscription & Auto-Pay Management Policy

This Subscription & Auto-Pay Management Policy ("Policy") governs all subscription plans, recurring payment arrangements, billing cycles, and auto-pay features available through the CabChalak platform ("Platform"). This Policy forms an integral part of the Terms of Service. By enrolling in any subscription plan or enabling auto-pay, you agree to this Policy.

1. SCOPE & APPLICABILITY

This Policy applies to:

  • Users who opt for premium subscription plans on CabChalak
  • Users who enable auto-pay or recurring payment features
  • Any recurring or subscription-based charges processed through the Platform

Note: This Policy covers subscription services only. Commission payments and booking-related charges are governed by the Terms of Service and Refund & Cancellation Policy.

2. SUBSCRIPTION PLANS OVERVIEW

CabChalak offers subscription plans for Agents and Drivers to unlock premium features, reduced commissions, and priority support.

2.1 Available Plans

All Plans are free for new launch of app but we will charge later.

3. AUTO-PAY SYSTEM

3.1 How Auto-Pay Works

Auto-Pay is an automatic recurring payment system where:

  • Your subscription renewal amount is charged automatically on the renewal date
  • Payment is processed through your registered payment method (UPI, bank account, card)
  • You will receive a reminder notification 1-2 days before the auto-pay date
  • Successful payment confirmation sent via SMS/email within 24 hours

3.2 Auto-Pay Enrollment

When you subscribe to a paid plan:

  1. You are informed of the auto-pay terms during signup
  2. You must provide explicit consent ("I agree to auto-pay for renewals")
  3. Your payment method is securely stored (PCI-compliant via Razorpay)
  4. Auto-pay is enabled by default for paid plans

3.3 Payment Methods Accepted

CabChalak accepts the following payment methods for auto-pay:

  • UPI (Google Pay, PhonePe, Paytm, BHIM, etc.)
  • Bank Account (Direct debit / NEFT)
  • Credit/Debit Card (Visa, Mastercard, RuPay)
  • Digital Wallets (as supported by Razorpay)

4. BILLING & PAYMENT CYCLES

4.1 Billing Schedule

4.2 Subscription Period

Your subscription begins on the date of successful payment and ends on the date specified (monthly, quarterly, half yearly or annual).

4.3 Invoice & Receipt

  • An invoice is generated after each successful auto-pay transaction
  • Invoice is sent via email to your registered account email
  • Invoices are also available in your account under "Billing History"
  • GST is applied as per applicable tax laws (if your turnover exceeds threshold)

5. AUTO-PAY MANAGEMENT & CONTROL

5.1 Modify or Pause Auto-Pay

You can modify your auto-pay settings anytime:

To Enable Auto-Pay:

  • Go to Account Settings → Subscription → Enable Auto-Pay
  • Select your preferred payment method
  • Confirm and save

To Disable Auto-Pay:

  • Go to Account Settings → Subscription → Manage Auto-Pay
  • Click Disable Auto-Pay
  • Your subscription will end on the current renewal date (no further charges)
  • Your current plan benefits remain active until expiry

To Pause Auto-Pay (Temporarily):

  • Select Pause Auto-Pay for a specific cycle
  • Auto-pay will resume on the next billing cycle
  • You will receive a reminder

5.2 Change Payment Method

To update your auto-pay payment method:

  1. Go to Settings → Payment Methods
  2. Add a new payment method or select an existing one
  3. Mark as "Primary for Auto-Pay"
  4. Old method will no longer be used for future charges

5.3 Upgrade or Downgrade Plan

Upgrade to Higher Plan:

  • The difference amount (pro-rata) will be charged immediately
  • Your new plan benefits activate immediately
  • Renewal date may be adjusted (will be communicated)

Downgrade to Lower Plan:

  • Changes take effect from the next billing cycle
  • No immediate refund for the remainder of current period
  • You will enjoy new plan benefits from next renewal

6. FAILED PAYMENT HANDLING

6.1 Payment Failure Scenarios

Auto-pay may fail due to:

  • Insufficient balance in bank account
  • Expired card / invalid UPI ID
  • Bank or payment gateway downtime
  • Incorrect card/UPI details

6.2 Retry Mechanism

If your auto-pay fails:

  1. First Attempt: Automatic retry within 24 hours
  2. Second Attempt: Automatic retry within 48 hours
  3. Third Attempt: Automatic retry within 72 hours (final attempt)
  4. Notification: You will receive SMS/email alerts after each failed attempt

6.3 After Failed Payment

  • If all retries fail, your subscription will be put on hold
  • Premium features will be suspended until payment is successful
  • You can manually pay via "Resume Subscription" option
  • A grace period of 1 day is provided to update payment method and retry

6.4 Subscription Suspension

After 1 day of non-payment:

  • Your subscription is deactivated
  • You revert to Free (Basic) plan
  • All premium benefits stop immediately
  • You can reactivate by making the pending payment

7. REFUND POLICY FOR SUBSCRIPTIONS

7.1 Cancellation & Refunds

Refund Eligibility:

  • Within 24 hours of enrollment: Full refund if subscription is cancelled before accessing premium features
  • After 24 hours: No refund; pro-rata amount may be credited to next cycle (at discretion)
  • Mid-cycle cancellation: No refund; benefits remain active until end of current cycle

7.2 How to Request Refund

  1. Email support@cabchalak.in with subject "Subscription Refund Request"
  2. Include: Order ID, Transaction ID, Reason for cancellation
  3. Support will review within 5 business days
  4. If eligible, refund is processed within 7-10 business days

7.3 Non-Refundable Scenarios

  • ❌ Plan downgrade (no refund for difference)
  • ❌ Cancellation after using premium features for 7+ days
  • ❌ Chargebacks or payment gateway reversals
  • ❌ Violation of Terms of Service

8. SUBSCRIPTION BENEFITS & FEATURES

8.1 Plan Features Breakdown

FREE (Basic Plan)

  • ✅ Standard booking posting/acceptance
  • ✅ Basic commission rates (5-15%)
  • ✅ Email support
  • ✅ Transaction history

8.2 Feature Activation

Premium features activate immediately after successful payment and remain active for the duration of your subscription.

9. PROMOTIONAL OFFERS & DISCOUNTS

9.1 Promotional Codes

CabChalak may offer promotional codes for:

  • First-time subscribers: 0-30% discount
  • Seasonal offers: Limited-time discounts
  • Referral bonuses: Get discounts by referring friends

9.2 How to Apply Promo Code

  1. During checkout, enter the promo code in "Apply Code" field
  2. Discount will be calculated and reflected in final amount
  3. Code is valid for single use only (unless otherwise specified)
  4. Expired codes cannot be reused

9.3 Promo Code Terms

  • ✅ Cannot be combined with other offers
  • ✅ Valid only for new subscriptions (unless stated)
  • ✅ Discount applies to current month/cycle only
  • ❌ No cash-back for unused portion

10. PLAN DISCONTINUATION & LEGACY USERS

10.1 Plan Changes

CabChalak may discontinue, modify, or introduce new subscription plans. Users will be notified 30 days in advance.

10.2 Existing Subscribers

If your plan is discontinued:

  • You can continue until your current cycle ends
  • Renewal will be transferred to equivalent new plan (or higher)
  • No additional charges for the remainder of current period

11. TAXATION (GST & COMPLIANCE)

11.1 Subscription Cost & GST

  • Subscription prices shown exclude GST (where applicable)
  • GST is added during checkout if your account is registered as GST-liable
  • Final invoice amount = Subscription price + GST

11.2 GST Registration

  • If your annual turnover exceeds ₹40 lakh (businesses) or ₹20 lakh (individuals), you must be GST-registered
  • Provide your GST number during KYC for GST invoices
  • CabChalak will issue GST-compliant invoices

12. ACCOUNT TERMINATION & SUBSCRIPTIONS

12.1 Account Closure with Active Subscription

If you close your CabChalak account with an active subscription:

  • Any remaining subscription balance will not be refunded
  • Your account and benefits are deactivated immediately
  • All data is handled as per Privacy Policy

12.2 Data After Subscription Expiry

After your subscription ends (or is cancelled):

  • Your account reverts to Free (Basic) plan
  • All premium features are disabled
  • Historical data and transaction records remain accessible
  • You can reactivate subscription anytime to regain premium access

13. CHANGES TO THIS POLICY

CabChalak may update this Subscription & Auto-Pay Policy periodically for:

  • New subscription plans or features
  • Changes in pricing or billing cycles
  • New payment methods or partners
  • Regulatory or legal requirements

How You'll Know:

  • Updated date displayed at the top
  • Email notification for material changes
  • In-app notification
  • Continued use = acceptance of updated policy

Include in your request:

  • Full name and registered mobile number
  • Subscription plan name and order ID
  • Issue description (with screenshots if applicable)
  • Preferred resolution

Response Time: 24-48 hours acknowledgment, 5-7 days resolution.

15. DISPUTE RESOLUTION

15.1 Billing Disputes

If you dispute an auto-pay charge:

  1. Report within 30 days of the charge
  2. Submit evidence: screenshots, transaction details
  3. CabChalak will review within 7-10 business days
  4. Final decision is binding for platform purposes

15.2 Chargeback & Payment Reversal

If you file a chargeback or payment reversal with your bank:

  • CabChalak reserves the right to suspend your account
  • You must settle the disputed amount + ₹500 chargeback fee
  • Repeated chargebacks may result in permanent account closure

16. ACCEPTANCE

By enrolling in a subscription plan or enabling auto-pay on CabChalak, you:

  • ✅ Confirm you have read and understood this Subscription & Auto-Pay Policy
  • ✅ Consent to automatic recurring payments on the schedule specified
  • ✅ Authorize CabChalak to charge your registered payment method
  • ✅ Understand the cancellation and refund terms
  • ✅ Agree to manage your auto-pay preferences via account settings
  • ✅ Accept that GST (if applicable) will be added to subscription cost
