Marketplace & Commission Facilitation Policy

This Marketplace & Commission Facilitation Policy ("Marketplace Policy") forms an integral and binding part of the CabChalak Terms of Service. It governs marketplace operations, commission flows, platform fees (2-3.5% varies), and facilitation services between Agents and Drivers. You are advised to review this Marketplace Policy periodically for any changes. Changes are effective when posted on the Platform.

1. NATURE OF CABCHALAK MARKETPLACE

1.1 What CabChalak Provides

CabChalak operates as a technology marketplace:

  • Agents post cab bookings with fixed Rupee commission (any amount they choose)
  • Drivers view available bookings and accept by paying commission via Razorpay
  • CabChalak deducts 4% Platform Fee (new launch rate) from commission
  • Remaining amount auto-transferred to Agent after 24-48 hours

1.2 What CabChalak is NOT

  • ❌ Taxi operator or transport provider
  • ❌ Employer/partner of Drivers/Agents
  • ❌ Party to trip fare contracts
  • ❌ Responsible for service quality or vehicle operations

1.3 No Merchant of Record

Trip fares settled directly between Drivers/Agents and Customers. CabChalak handles commissions only.

2. MARKETPLACE ROLES

2.1 Agent Responsibilities

  • Post genuine bookings with fixed Rupee commission (any amount)
  • Provide accurate pickup/drop details
  • Subscription required to receive trip visibility
  • Accept Platform dispute decisions

2.2 Driver Responsibilities

  • Subscription required to view/accept trips
  • Pay fixed Rupee commission upfront to accept
  • Mark accurate pickup/completion times
  • Fulfill bookings or cancel per Refund Policy

2.3 Rating System

  • Agents & Drivers rated on completion rate, response time, disputes
  • Higher ratings = better trip visibility
  • Low ratings reduce booking opportunities

3. COMMISSION PAYMENT FLOW

Example Commission Flow:
1. Agent posts: "Delhi-Mumbai, Commission ₹800"
2. Driver accepts → Pays ₹800 via Razorpay
3. CabChalak deducts 4% = ₹32 Platform Fee
4. Agent receives ₹768 after 24-48 hours

3.1 Platform Fee (New Launch)

Note: Normal rate 3.5-5%. Currently fixed 4% for new launch.

4. PAYMENT & HOLD PERIODS

Disputes 7-30 days After resolution
Fraud Investigation Up to 30 days After verification

4.1 No Escrow

  • Funds held temporarily for settlement verification
  • CabChalak is not a bank
  • No interest paid on held amounts

5. SUBSCRIPTION REQUIREMENT

Critical Marketplace Rule:
❌ No Subscription = No Trip Visibility
✅ Active Subscription = View & Accept Trips

  • Free users: Cannot see or accept bookings
  • Paid subscribers (Pro/Premium/Elite): Full marketplace access
  • Ratings + subscription determine trip priority

6. COMMISSION DISPUTE RESOLUTION

6.1 Eligible Disputes (Commissions Only)

  • ✅ Technical failures
  • ✅ Timing disagreements
  • ✅ Fraud claims
  • ❌ Trip fare disputes (direct between parties)

6.2 Process

  1. Raise within 48 hours → support@cabchalak.in
  2. Submit evidence (screenshots, timestamps)
  3. Platform decision final (7-15 days)

7. PROHIBITED PRACTICES

Violation Penalty
Fake bookings Account suspension
Commission manipulation 30-day payment hold
Multiple fake accounts Permanent ban
Chargeback abuse Legal action

8. TAXATION

  • CabChalak: GST only on 4% Platform Fee
  • Agents/Drivers: Responsible for GST on their commission earnings

9. MARKETPLACE ACCEPTANCE

By using CabChalak marketplace, you:

  • ✅ Accept 4% Platform Fee (new launch rate)
  • ✅ Confirm subscription required for trip access
  • ✅ Agree commissions in fixed Rupees (any amount)
  • ✅ Understand 24-48 hour payouts (normal trips)
  • ✅ Acknowledge trip fares outside scope
  • ✅ Accept all other policies (Terms, Privacy, Refund, Subscription)
